This paper presents an overview of the dimensions of unsafe motherhood, contrasting data from economically developed countries with some from developing countries. It addresses many common factors that shape unsafe motherhood, identifying medical, health system and societal causes, including women's powerlessness over their reproductive lives in particular as a feature of their dependent status in general. Drawing on perceptions of Jonathan Mann, it focuses on public health dimensions of maternity risks, and equates the role of bioethics in conscientious medical care (...) to that of human rights in public health care. The concept of reproductive health promises to play a crucial role in improving health care provision and legal protection for women around the world. This is an authoritative and much-needed introduction to and defence of the concept of reproductive health, which though internationally endorsed, is still contested. The authors are leading authorities on reproductive medicine, women's health, human rights, medical law, and bioethics. They integrate their disciplines to provide an accessible but comprehensive picture. They analyse 15 cases from different countries (...) and cultures, and explore options for resolution. This article explores the effectiveness of the decision of the Committee on the Elimination of Discrimination against Women in the case of Alyne da Silva Pimentel Teixeira (deceased) v. Brazil, concerning a poor, Afro-Brazilian woman. This is the first decision of an international human rights treaty body to hold a state accountable for its failure to prevent an avoidable death in childbirth. Assessing the future effectiveness of this decision might be undertaken concretely by determining the degree of Brazil's actual compliance (...) with the Committee's recommendations, and how this decision influences pending domestic litigation arising from the maternal death. Alternative approaches include: determining whether, over time, the decision leads to the elimination of discrimination against women of poor, minority racial status in the health sector, and if it narrows the wide gap between rates of maternal mortality of poor, Afro-Brazilian women and the country's general female population. Determining the effectiveness of this decision will guide whether to pursue a more general strategy of judicializing maternal mortality. (shrink)

Alyne da Silva Pimentel Teixeira died of postpartum hemorrhage following the stillbirth of a 27-week-old fetus on November 16, 2002 in Rio de Janeiro, Brazil. Her death led in 2011 to the first decision of an international treaty body holding a government accountable for a preventable maternal death. The decision, Alyne da Silva Pimentel Teixeira v. Brazil, was given by the Committee on the Elimination of Discrimination against Women, established to monitor compliance by member states with the UN Convention on (...) the Elimination of All Forms of Discrimination against Women. The decision upheld a complaint, filed in 2007 against the state and government of Brazil, finding discrimination in the field of health care for Alyne’s avoidable maternal death, in breach of the Women’s Convention. We report an experiment investigating the “special-process” theory of insight problem solving, which claims that insight arises from non-conscious, non-reportable processes that enable problem re-structuring. We predicted that reducing opportunities for speech-based processing during insight problem solving should permit special processes to function more effectively and gain conscious awareness, thereby facilitating insight. We distracted speech-based processing by using either articulatory suppression or irrelevant speech, with findings for these conditions supporting the predicted insight facilitation effect relative to silent working or thinking (...) aloud. The latter condition was included to investigate the currently contested effect of “verbal overshadowing” on insight, whereby thinking aloud is claimed to hinder the operation of special, non-reportable processes. Whilst verbal overshadowing was not evident in final solution rates, there was nevertheless support for verbal overshadowing up to and beyond.. (shrink)

Since our visual perception of physical things essentially involves our identifying objects by their colours, any theory of visual perception must contain some account of the colours of things. The central problem with colour has to do with relating our normal, everyday colour perceptions to what science, i.e. physics, teaches us about physical objects and their qualities. Although we perceive colours as categorical surface properties of things, colour perceptions are explained by introducing physical properties like reflectance profiles or dispositions to (...) cause certain experiences in normal human perceivers. Hence, it seems as if colours as they are experienced by us have no place in the physical world, because they are fundamentally different from the properties which we ascribe to physical objects in scientific accounts of colour perceptions. Writing in the mid-seventeenth century, Spinoza tried to provide conceptual foundations for the newly developing "natural philosophy" of his day. His monism, naturalism, and theory of mind are still intriguing today, but they are (...) notoriously difficult to understand. There is little interpretive consensus with regard to even the most basic concepts and claims. In Spinoza: Metaphysical Themes the diversity of interpretive perspective is vividly on display.All of the eleven essays in this collection are published here for the first time. They cover a broad range of topics and, taken together, they move us forward in our understanding of Spinoza's basic doctrines. Most of the essays are carefully argued discussions of clearly defined issues of interpretation. They address matters that are central to the system and central to our understanding of the system—monism, causation, individuation, conatus.The editors' Introduction claims that Jonathan Bennett's 1986 work set a new standard of Spinoza scholarship—a standard that the essays in this volume seek to measure up to. Most (not all) of these essays do indeed come close to Bennett's commendable level of argumentative clarity and rigor. And here, as in Bennett's work, the emphasis is mostly systematic and argumentative, not historical.The collection opens with a very good essay by Michael Della Rocca entitled "Spinoza's Substance Monism." This essay applies to the thorny issue of substance monism the same argumentative strategy that Della Rocca has elsewhere applied to monism regarding individual modes—i.e., to the claim that an extended mode and the idea of that mode are identical. The argument turns on the complete conceptual independence of the attributes, and Della Rocca makes a strong case for the centrality of that somewhat puzzling doctrine. John Carriero's contribution ("Monism in Spinoza") continues the focus on monism, but from a different perspective. Carriero asks, "Why does Spinoza hold that finite... bodies [End Page 560] are not substances?" (47). Rejecting two traditional responses he provides a plausible answer to this good question by focusing on an early exchange of letters between Spinoza and Oldenburg and upon Spinoza's rethinking of Descartes's conception of extension.One of the most interesting essays is Don Garrett's interpretive discussion of Spinoza's derivation of the conatus doctrine at Ethics3p4-3p6 ("Spinoza's Conatus Argument"). Commentators have identified various putative fallacies in the argument that Spinoza offers for this doctrine—chiefly fallacies of equivocation. Garrett develops an interesting and plausible notion of "inherence" that casts light on a number of central metaphysical relations and permits a defensible reading of the conatus argument. For the serious Spinoza scholar, this one essay is worth the price of the volume.Olli Koistinen's "Causation in Spinoza" considers Spinoza's solution to the difficulty of causal interaction between substances—a glaring problem in Descartes that provoked glaringly problematic solutions from Malebranche and Leibniz. Richard Manning's essay addresses a controversial point in Jonathan Bennett's interpretation. The issue is whether, in Spinoza's system, mental content can have causal significance—a point closely related to the important issue of teleological explanation of human behavior. Manning supports a kind of "thoughtful teleology," making a convincing case for the causal efficacy of mental content.On the whole the authors in this volume restrict their discussion of secondary literature to the works of fellow Anglophones. One finds occasional mention of Gueroult, but the Continental literature on Spinoza is mostly ignored. There are two notable exceptions to this rule. Steven Barbone ("What Counts as an Individual for Spinoza?") discusses the thorny issue of modal individuation in Spinoza's system, arguing against Matheron's 1969 claim that for Spinoza the state is an individual. Emphasizing the centrality of power, Barbone draws important (liberal) political conclusions from his analysis of individuation. But according to Kisner and Youpa, Spinoza thought that metaphysics and epistemology were significant chiefly because they are required for understanding the more important part of his project—the ethical doctrine developed in the last three parts of the work. What kinds of time are opened, disclosed, or foreclosed in such moments? This section explores a concept that has a long history in rhetoric and philosophy, but which is urgently called for now, in a time that many think of as critical, catastrophic, or even apocalyptic. Changes in the (...) economy, climate, and the state of our democracies demand urgent attention, and while people disagree on the course to be taken, there is a sense that—this is it!—now is the time. The concept of kairos (from ancient Greek καιρός) comprises both a critical time and a perfect opportunity; it is the right moment to act, even though the word could also be interpreted in a more general sense as referring to the issue of right timing. Considered as "one of the most untranslatable of Greek words," kairos is perhaps related to the verb kurō, "to meet" or "meet accidentally," as when an arrow meets a target, suggesting that there is a spatial component in the temporal kairos.1 The spatial dimension shines through in the earliest uses of the term discussed in both SeungJung Kim's article on ancient Greek visual arts and Robert Sullivan's article on Isocrates (436–338 BCE). According to Sullivan's survey, Isocrates most often employs the word to refer to a specific situation, occasion, state of affairs, or set of circumstances.How do you recognize, let alone seize, this kind of moment, though? The best-known depiction of this difficulty is a portrait of Kairos personified that dates back to Lysippos in the fourth century BCE, reconstructed visually in three dimensions in Kim's essay. In Greek mythology Kairos is the god of golden opportunities, which (as we all know!) tend to pass by too quickly. The portrait shows a winged figure with a flowing forelock that ideally gives you something to hold on to. I like to imagine that if you [End Page 267] manage to arrest this passing instant, time itself comes to an abrupt halt, which throws Kairos's hair out in front of his face.Of course, people do not necessarily see it as positive when someone appears to have captured the moment. At the kairos symposium hosted by art historian Barbara Baert in Brussels in October 2018, W. J. T. Mitchell held up a picture of President Donald Trump's sculpted forelock to illustrate that it all depends on the perspective. Turning the familiar Greek portrait into an image of the opportunist, Mitchell reminded all of us that had gathered to celebrate the legacy of kairos in iconographic, philosophical, theological, semantic, historical, and anthropological studies, of the ethical issues arising in such moments. The question of moral accountability is bound to come up, whether one takes kairos to refer to the act of seizing the moment, involving some form of decision, or to the moment itself, the kairos, which some might claim just seized upon them and carried them away.As Debra Hawhee and Erik Charles White before her have argued, kairos does not seem to be confined by the subjective reason operating in a "rhetorical situation," but it depends on "the forces pushing on the encounter," in addition to instinct and intuition, and possibly on habitual impulses springing from experience (Hawhee 2002, 24–25; White 1987; reconsidered by Brod 2021). Audiences may also have a significant role to play, as Kermit Campbell underscores in his discussion of the symbiosis of call and response in African American churches and his reflection on how Martin Luther King's speech at the 1963 March on Washington replied to a call: "Tell them about the dream, Martin."The moment of kairos may appear spontaneous and deliberate, both at the same time. The classical rhetoricians in fact insisted on the value of preparing for the unexpected, as we try to do in our current crisis management plans. In his essay, Sullivan documents the incredibly nuanced instructions Isocrates gave on how to exploit a prospective opening in all sorts of civic settings. Review of Daniel Cook, Hartmut Rudolph, and Christoph Schulte, editors. _Leibniz und das Judentum_. Studia Leibnitiana Sonderhefte, 34. Stuttgart: Steiner, 2008. Pp. 283.

It is well known that people from other disciplines have made significant contributions to philosophy and have influenced philosophers. It is also true (though perhaps not often realized, since philosophers are not on the receiving end, so to speak) that philosophers have made significant contributions to other disciplines and have influenced researchers in these other disciplines, sometimes more so than they have influenced philosophy itself. But what is perhaps not as well known as it ought to be is that researchers (...) in other disciplines, writing in those other disciplines' journals and conference proceedings, are doing philosophically sophisticated work, work that we in philosophy ignore at our peril. Work in cognitive science and artificial intelligence (AI) often overlaps such paradigmatic philosophical specialties as logic, the philosophy of mind, the philosophy of language, and the philosophy of action. This special issue offers a sampling of research in cognitive science and AI that is philosophically relevant and philosophically sophisticated. (shrink)

Foreword from the Guest Editor to the special issue of Diametros – “Enlightenment and Secularism.”.

Existing accounts of meaning in reproductive contexts, especially those put forward in debates concerning abortion, tend to focus on the (moral) status of the fetus. This issue on miscarriage, pregnancy loss, and fetal death accomplishes a shift this conversation, in the direction of pushing past embryo-centric value judgments. To put it bluntly, the miscarried embryo is not the one who has to live with the experience. The essays in this special issue are a significant addition to the scarce literature on (...) miscarriage and fetal death. Contributions are from specialists in continental and analytical philosophy, feminism, bioethics, theoretical and applied ethics, social and political philosophy, social epistemology and philosophy of language, narrative, aesthetics, popular culture, and gender studies. As guest editors, we sought to offer a variety of approaches to the topic, to further the understanding of miscarriage and fetal death as important to many areas of philosophy, especially social philosophy. We suggest that the unchosenness and invisibility of miscarriage are central to its seeming irrelevance to social identities and social norms of testimony, recognition, and ascription of significance to experiences. As with the society and social values from which its moral framework is derived, so medical ethics has been subjected to intense scrutiny by the emergence of this new disease. Few areas of ethical discourse have been untouched. This infection is so intensely private in its transmission, the disease so isolating and so personally devastating in its impact, it readily distinguishes the reality of what people are and do, from the rhetoric of what others may feel they should be and do. AIDS has forced us to recognise that respecting individual rights is a critical safeguard for the health of the community, as well as for the person. These issues are well illustrated by the interweaving issues of patient empowerment, respect for confidentiality, and patient advocacy and activism.EMPOWERMENTPhysicians in this field have been struck by the way in which people affected have wanted to be involved in decision making. Research over the past half century has produced extensive evidence that observers cannot report or retain all of the details of their visual world from one moment to the next. During the past decade, a new set of studies has illustrated just how pervasive these limits are. For example, early evidence for the failure to detect changes to simple dot patterns (Phillips, 1974) and arrays of letters (Pashler, 1988) generalizes to more naturalistic displays such as photographs and motion pictures (e.g., (...) Levin & Simons, 1997; Rensink, O’Regan, & Clark, 1997; see Rensink, 2002 for a recent review). This failure to report changes (change blindness) can be induced in both simple and naturalistic displays, whenever the change co-occurs with a visual disruption such as an eye movement (Currie, McConkie, Carlson-Radvansky, & Irwin, 1995; Hollingworth, Schrock, & Henderson, 2001), image shift (Blackmore, Brelstaff, Nelson, & Troscianko, 1995), flashed blank screen (Rensink et al., 1997), blink (O’Regan, Deubel, Clark, & Rensink, 2000), transient (O’Regan, Rensink, & Clark, 1999; Rensink, O’Regan, & Clark, 2000), movie cut or pan (Levin & Simons, 1997; Simons, 1996), or an occlusion event (Levin, Simons, Angelone, & Chabris, 2002; Simons & Levin, 1998). Change blindness can also occur in the absence of a disruption, provided the change occurs gradually enough that it does not attract attention (Simons, Franconeri, & Reimer, 2000). -/- Failures of visual awareness have been induced in a number of ways. For example, observers often fail to report a visible but unexpected stimulus when attention is focused on some other object or event in the display (inattentional blindness). As for change blindness, inattentional blindness occurs for both simple (Mack & Rock, 1998; Most et al., 2001) and naturalistic stimuli (Simons & Chabris, 1999). Similarly, repeated instances of an item often go undetected when embedded in a rapid sequence (repetition blindness), a phenomenon that occurs for both words and pictures (Kanwisher, 1987; Kanwisher & Potter, 1990). Observers can also fail to detect a stimulus in a rapid stream of stimuli provided they had to perform an attention-demanding task shortly before the stimulus appeared (Shapiro, Arnell, & Raymond, 1997). The surprisingly large variety of conditions that induce failures of conscious perception reinforces the broad conclusion that we are often unaware of what would otherwise be fully-visible stimuli. -/- Along with an increased appreciation of the limitations of visual awareness has come a renewed interest in using these limitations to explore the nature of the representations and processes underlying our visual experience. Are these limitations due to failures of perception? Of attention? Of memory? What is preserved with and without awareness? -/- The papers in this special issue of the Journal of Vision provide examples of exciting new work on induced failures of visual awareness and the mechanisms that underlie them. For example, several papers examine whether observers are drawn to parts of a display by the stimulus features or whether top-down control or semantic comprehension influence search through a display. Others investigate the nature of and limits on the information that is preserved from one view to the next and how much information needs to be retained for effective perception and action. As guest editors, we hope that this special issue will illustrate how studying the relationship between visual awareness and visual representations can lead to important new insights into the nature of seeing. If I have any objection to this book, it is to the title, in that it might narrow the audience that would benefit from it. Although the title is formally quite accurate in describing the contents, it underplays the relevance of the arguments set out herein to a very broad range of clinical arenas, for which HIV/AIDS can be a notable example. This fascinating series of essays covering the topics in the subtitle and much more, shows how valuable AIDS has (...) been as a worked example of a series of interdigitating core issues in medical ethics, as it has been in so many areas of clinical medicine, public health and public policy. Although the authors and editors underplay this wider relevance, I found myself, despite my own substantial involvement in HIV and AIDS over the past …. (shrink)
